This website (atlantapickles.com) is operated by Evergreen and Market, trading as [PICKLES] ("we", "us", "our"), 4660 Hammermill Road, Tucker, GA 30084, United States. By visiting our site, buying from us online, at a market or event, or through any of our sales channels, you agree to these Terms of Service ("Terms") and to the policies they reference, including our Refund Policy, Shipping Policy, Cancellation Policy and Privacy Policy. If you do not agree, please do not use the site or buy our products. We may update these Terms at any time by posting the new version here; continued use of the site or purchases after a change means you accept it. Our store is hosted on Shopify Inc.

SECTION 1 - USING OUR STORE
You must be at least the age of majority where you live, or have the consent of a parent or guardian, to use this site. You may not use our products or site for any illegal or unauthorized purpose, or transmit any malicious code. We may refuse service, cancel orders or close accounts at any time, including orders that appear to be placed by resellers or that use another person's payment details.

SECTION 2 - INFORMATION ON THIS SITE
We work hard to keep the information on this site accurate and current, but it is provided for general information only and may contain errors or omissions in descriptions, ingredients, pricing, availability, shipping charges or transit times. We may correct any error, change information, or cancel an order affected by an error at any time, even after you have placed it. Photos are representative: colors, sizes and the look of handmade products vary.

SECTION 3 - PRICES, ORDERS AND PAYMENT
Prices, products, promotions and discount codes may change or be discontinued at any time without notice. Unless a promotion says otherwise, only one discount can be applied to a product. We may limit quantities per person, household or order. You agree to give current, complete and accurate purchase and account information. Payment is due at the time of order.

SECTION 4 - MADE TO ORDER, RETURNS AND CANCELLATIONS
Every jar is made to order. Returns, refunds, replacements and cancellations are governed by our Refund Policy and Cancellation Policy, which form part of these Terms. Damaged, defective or incorrect orders must be reported within 24 hours of delivery with photos.

SECTION 5A - PRODUCT DESCRIPTIONS, INGREDIENTS AND HEALTH STATEMENTS
We use organic ingredients wherever we can, many sourced from small local farms that are not certified organic; our products are therefore not certified organic. "Non-GMO" refers to the ingredients we buy and is based on our suppliers' information. "Halal-friendly" and "kosher-friendly" refer to our ingredients; our kitchen is not halal or kosher certified. Descriptions such as "gut-friendly" and "hydrating" describe our ingredients and brine, not a medical effect. Our products are foods, not dietary supplements, and are not intended to diagnose, treat, cure or prevent any disease; statements on this site have not been evaluated by the FDA. Customers with allergies, dietary restrictions or medical conditions should read the ingredient label on each jar and consult a healthcare professional. Figures such as jars sold and sodium comparisons are our own good-faith estimates.

SECTION 5B - ALLERGENS, LABELS AND PRODUCT SAFETY
Always read the ingredient label on each jar before eating; the label on the jar you receive is the authoritative ingredient list. Our kitchen handles many ingredients, including spices, mustard seed, garlic, peppers, fruit and other produce, and cross-contact is possible. If you have a food allergy or sensitivity, do not eat a product unless you are sure it is safe for you. Some products are very spicy (for example habanero and ghost pepper); handle and eat them with care and keep them away from eyes and children. Our products are packed in glass: inspect the jar before opening, and do not eat from a jar that is chipped, cracked, leaking or bulging, whose seal is broken, or that smells off.

SECTION 5C - NATURAL VARIATION AND STORAGE
Our pickles are handmade in small batches from fresh, seasonal produce, so color, size, crunch, spice level, whole spices and sediment in the jar, and how the produce settles can vary from batch to batch and from the photos on this site. Contents may settle in transit; the net weight is stated on each label. Unopened jars are shelf-stable; once opened, keep refrigerated and use clean utensils. We are not responsible for products that are stored or handled improperly after delivery. We buy much of our produce directly from small local farms and family growers we know, and we choose our ingredients with care because good, sustainable food is our first mission.

SECTION 6 - REVIEWS, COMMENTS AND SUBMISSIONS
We welcome honest reviews, positive and negative, and we do not remove or hide reviews because of their rating. We may remove a review, whatever its rating, if it is fake or written by someone who did not buy or use the product; if it is written by a competitor, an employee, or someone with an undisclosed business relationship with us or a competitor; if it is unrelated to our products or service; or if it contains personal information, offensive, harassing, defamatory or unlawful content, or links and advertising. Anyone who makes or sells pickles or similar products must disclose that in any review they post. Ideas, feedback, photos and other content you send us may be used by us without obligation or payment. You are responsible for what you post and must not impersonate anyone or post false information.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS
Our site uses third-party services (for example Shopify, payment processors, shipping carriers, review apps and marketplaces). We are not responsible for their content, policies or performance; use of them is at your own risk and subject to their terms.

SECTION 8 - PERSONAL INFORMATION
Your personal information is handled under our Privacy Policy.

SECTION 9 - PROHIBITED USES
You may not use the site or its content to break any law; infringe our or anyone's intellectual property (including the [PICKLES] name, logo and trademark); harass, defame or discriminate; submit false or misleading information or reviews; upload malicious code; scrape, crawl or collect others' data; or interfere with the site's security. We may end your use of the site for any of these.

SECTION 10 - DISCLAIMER OF WARRANTIES
Except as expressly stated by us or required by law, the site and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free, or that products will meet every taste or expectation.

SECTION 11 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Evergreen and Market, [PICKLES], and our owners, officers, employees, contractors, suppliers and farmers will not be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits, arising from your use of the site or our products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states do not allow these limits, so they apply only as far as the law allows. Nothing in these Terms limits liability that cannot be limited by law.

SECTION 12 - INDEMNIFICATION
You agree to indemnify and hold harmless Evergreen and Market and our owners, employees, contractors and suppliers from claims, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of our products, or your violation of any law or third-party right.

SECTION 13 - DISPUTES, GOVERNING LAW AND VENUE
If you have a problem, please contact us first at info@evergreenandmarket.com; most issues are solved quickly, and you agree to give us 30 days to try to resolve a dispute informally before starting any legal action. These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any legal action must be brought in the state or federal courts located in DeKalb County, Georgia, except that either party may bring an individual claim in small claims court. Any claim must be brought within one year after it arises, where the law allows.

SECTION 14 - SEVERABILITY, ENTIRE AGREEMENT AND TERMINATION
If any part of these Terms is found unenforceable, it will be enforced to the fullest extent allowed and the rest will remain in effect. Our failure to enforce any right is not a waiver. These Terms and the policies they reference are the entire agreement between you and us about the site and our products and replace any earlier versions. We may suspend or end your access to the site if you break these Terms; obligations that arose before then survive.
